FOSTER PROGRAM

RELEASE AND INDEMNIFICATION AGREEMENT

 

*          I/we desire to participate in the Foster Program of Houston Animal Rescue Team – HART and do consent and agree to the terms and conditions set out below. I/we understand that these terms are a prerequisite to my/our eligibility to participate in the Foster Program. Further, I/we understand that the acceptance of these terms is made in consideration of Houston Animal Rescue Team – HART allowing me/us to participate in the Foster Program of Houston Animal Rescue Team – HART.

 

*          I/we acknowledge that I/we understand and agree to abide by the terms and conditions set out herein and any additional provisions that Houston Animal Rescue Team – HART may, from time to time, require for participation in the Foster Program.

 

*          Houston Animal Rescue Team – HART is under no obligation to use my/our services in the Foster Program and may terminate my/our participation in the Foster Program of Houston Animal Rescue Team – HART at any time, with or without reason, without notice to us.

 

*          I/we acknowledge and understand that I/we will receive no compensation, wages, insurance coverage, or any employment benefits for my/our participation in the Foster Program. While in the Animal Foster-Home Program, I/we must follow any rules or requirements of Houston Animal Rescue Team – HART, which may change these rules or requirements at any time without any notice to me/us. Houston Animal Rescue Team – HART has sole discretion to assign animals to me/us or to remove animals under the Animal Foster-Home Program.

 

*          I/we agree that Houston Animal Rescue Team – HART shall be considered the sole owner of any animal in Houston Animal Rescue Team – HART’s Foster Program, and I/we agree to assert no right of ownership against Houston Animal Rescue Team – HART.

 

*         Houston Animal Rescue Team – HART is not responsible for any expenses arising out of or in relation to my/our participation in the Animal Foster-Home Program.

 

*          Houston Animal Rescue Team – HART is not responsible for any diseases transmitted from the Foster Animal to any person or animal including me/us, any member of my/our household or family including animals, or any person or animal who may, directly or indirectly, come in contact with the Foster Animal.

 

*          Houston Animal Rescue Team – HART has the right to require the immediate return of any Foster Animal at any time with or without reason and without notice.

 

*          I/we further agree to furnish Houston Animal Rescue Team – HART a copy of all immunization and veterinary records related to a Foster Animal the day of return of the Foster Animal and upon request of Houston Animal Rescue Team – HART at any other time.

 

*          Houston Animal Rescue Team – HART will accept the return of any Foster Animal, during regular business hours, regardless of condition.

 

*          I/we understand that if I/we desire to adopt a Foster Animal placed with me/us, I/we must return the Foster Animal and go through Houston Animal Rescue Team – HART’s regular adoption process.

 

*          I/we agree to bring all my own animals current in their vaccinations before bringing a Foster Animal into my/our home and to provide documentation of such upon request.

 

*          I/we agree to abide by the animal regulations in effect at the location where the Foster Animal is kept.

 

*          I/we understand that some Foster Animals will not survive. If a Foster Animal dies, I/we agree to return the remains of the Foster Animal to The Oaks Veterinary Clinic.

 

*          I/we understand that Houston Animal Rescue Team – HART does not guarantee that any Foster Animal will ever be adopted.

 

*          I/we agree to immediately notify Houston Animal Rescue Team – HART in writing of our new address if I/we move or if I/we change the location where I/we keep the Foster Animal.

 

*          Nothing in this agreement is intended to, or may be deemed or construed to, create any rights or remedies in any third party.

 

*          Houston Animal Rescue Team – HART has advised me/us and I/we clearly understand and agree, such understanding and agreement being of the absolute essence to this agreement, that Houston Animal Rescue Team – HART has certified no funds under this agreement and I/we shall have no cause of action for money against Houston Animal Rescue Team – HART under this agreement.

 

*          I/we expressly agree that the execution of this agreement does not create any personal liability on the part of any director, employee, or agent of Houston Animal Rescue Team – HART.

 

*          I/we expressly understand and agree that if I/we fail or refuse to return to Houston Animal Rescue Team – HART any Foster Animal as provided in this agreement, I agree to pay to Houston Animal Rescue Team – HART all expenses incurred by Houston Animal Rescue Team – HART in obtaining or attempting to obtain the return of the Foster Animal from me/us. Such expenses include, but are not limited to, the value of staff time of Houston Animal Rescue Team – HART or its contractors and all legal expenses including court costs and litigation expenses including the value of any attorney time whether a government or a private attorney.

 

*          I/we acknowledges and understands that Houston Animal Rescue Team – HART has a mission, opinions, philosophies and policies that may not coincide with that of the Foster, and Foster agrees to communicate with Houston Animal Rescue Team – HART in a way that is honest and respectful. Personal attacks and defamation of Houston Animal Rescue Team – HART in any manner by a Foster are inconsistent with collaboration and cooperation and such behavior may result in termination of this Agreement.
